Agreeing to these terms
These terms cover your use of the Optimum Merced Concrete and Masonry website and any estimate, scheduling or work you arrange with us through it. By browsing our home page or any other page on the site, or by asking us for an estimate, you agree to these terms.
If you sign a written estimate or contract with us for a specific job, that document controls the details of that job. Where it says something different from these terms, the signed document wins.
What we do
We're a masonry contractor in Merced, CA, and we also do concrete work. That includes brick, block, stone, chimney, fireplace, paver, walkway and foundation work for homes in Merced and the cities around it. You can read more about who we are on our About page.
The descriptions on this site explain the kinds of work we do in general terms. They aren't a promise that we can take on a particular job, because every property is different and we have to see yours first.
Estimates and pricing
We give free estimates at your property, and there's no pressure to book. An estimate is based on what we can see and measure on the day we visit, along with the materials and scope you choose.
Some conditions only show up once the work is open, such as a weak footing, rotted framing behind a wall or old repairs that have to come out. If we find something like that, we'll stop, show you what we found and agree on any change in price or scope with you before we go further.
Prices on an estimate hold for the period written on it. After that, material and labor costs may change, so we may need to update the figure before scheduling.
Scheduling and cancellation
We set a start date with you once the estimate is accepted, and we'll keep you posted if it has to move. Weather, material delivery, permit timing and curing time for concrete and mortar can all push a schedule, and we won't rush work that needs time to set properly.
If you need to reschedule or cancel, call us or reach out as early as you can so we can adjust the crew. If materials were already ordered or work already started when you cancel, you're responsible for those costs as set out in your written estimate or contract.
Payment terms
Payment amounts, due dates and accepted methods are set out in your written estimate or contract. Please read that document before you sign, and ask us about anything that isn't clear.
If a payment is late, we may pause work until the account is brought current. We may also use any remedies California law allows to collect what's owed.
Your property and the work site
You agree to give our crew reasonable access to the work area and to tell us about anything we should know, such as buried lines, sprinklers, septic systems or past problems with the area. Telling us up front lets us plan around them and avoid damage.
You're responsible for making sure the work you ask for is allowed by your HOA or any other agreement that applies to your property. Where a job needs a permit, we'll talk with you about it during the estimate.
Warranty disclaimers
The information on this website is general and provided as is. We try to keep it accurate, but we don't promise that every page is complete, current or right for your situation.
Any warranty on our work is the one written into your contract, and only that one. Materials such as pavers, stone, brick and fireplace units may carry their own maker's warranty, which comes from the maker and follows the maker's terms.
Masonry and concrete behave in ways that aren't defects. Hairline cracks in concrete, small color differences between batches of brick or stone, and white mineral deposits on masonry can all happen with good work. Damage from settling soil, tree roots, standing water, misuse or changes made by others after we finish isn't covered unless your contract says it is.
Limitation of liability
To the extent California law allows, Optimum Merced Concrete and Masonry isn't liable for indirect, incidental or consequential losses from your use of this website or from our work. That includes lost use of your property, lost income or similar losses.
Where we are found liable for a job, our liability is limited to the amount you paid us for that job, unless the law requires otherwise. Nothing in these terms limits liability that can't be limited under California law.
Resolving disputes
If you have a problem with our work or a bill, call us first at (209) 308-1015 or reach us through our Contact page. Most issues get settled quickly once we come back out and look at it together.
If we can't settle it that way, either of us may take the matter to the courts serving Merced County, California, or use any other process your contract sets out.
Governing law
These terms and any work we do are governed by the laws of the State of California, without regard to its conflict of law rules.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one in effect. Changes don't affect a written contract you've already signed with us unless we both agree to them.
Questions about these terms
If anything here is unclear, call us at (209) 308-1015 or send a message through our Contact page, and we'll walk you through it.
